COMP USAGE AGREEMENT

1. ESSENTIAL INFORMATION

 PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. BY ACCEPTING THESE TERMS, YOU FORM A LEGAL AGREEMENT BETWEEN YOU AND Raksh Audio & Visuals Proprietorship Company (hereafter referred to as "Raksh"). By downloading any image from https://picturesbazaar.com, a fully owned subsidiary of Raksh, you agree to be bound by these terms. Raksh reserves the right to modify these terms at any time, and your continued use of the website will indicate your acceptance of such changes.

2. GENERAL

All images/videos available on this website are owned by Raksh, a division of Raksh Audio & Visuals Proprietorship Company, and are protected by Indian copyright laws and international treaties. You are granted limited, restricted rights to use these images/videos as outlined below. For any additional rights to use an image, you must license it by purchasing the image and agreeing to the applicable Raksh License Agreement available on https://picturesbazaar.com.
Raksh retains all rights not expressly granted in this agreement. This license will terminate automatically if you fail to comply with any of the terms. Upon termination, you must immediately stop using the images and destroy or return all copies, whether in digital, magnetic, solid-state, optical, or any other format, to Raksh. Your use of images from https://picturesbazaar.com must comply with all applicable laws, including but not limited to laws concerning moral rights.

3. LIMITED, RESTRICTED RIGHTS

Raksh grants you, the individual user, a non-exclusive, non-transferable right to copy a Raksh Exclusive Rights Image or Raksh Non-Exclusive Rights Image(s) onto one computer for one user at a time, for COMP USAGE and BROWSING only. COMP USAGE refers to the creation of a temporary test use, rough layout, or a comprehensive rendering of a proposed work for client review, internal company review, or testing purposes. The images may not be used in any materials that are distributed outside your company or made accessible to the public, or any final product, including online or other electronic distribution systems (except that you may send comps digitally or electronically to clients for review). The images may not be sold or sublicensed either alone or as part of any product. You agree not to use the images in any way that could be considered defamatory, pornographic, libelous, immoral, obscene, or fraudulent, either by making physical changes to the image or through the accompanying text. You further agree not to use Raksh or (https://picturesbazaar.com) for any content related to sensitive subject matter, as determined by Raksh, including, but not limited to, issues involving sexual content, sexually transmitted diseases, substance abuse, alcohol, tobacco, AIDS, cancer, mental health issues, alternative lifestyles, or physical or mental abuse, without prior written consent from Raksh and any models featured in such images/videos. Even if model releases are available, they do not grant the right to use an image in any of the sensitive subjects mentioned above. Except as expressly stated, Raksh Exclusive Rights or Non-Exclusive Rights images may not be used for any other purpose unless you have licensed the image for such use by purchasing it and agreeing to the terms of the corresponding Raksh License Agreement, which can be found on Raksh's website https://picturesbazaar.com for your review. Pornographic, defamatory, libelous, immoral, obscene, fraudulent, or otherwise unlawful use of the images is strictly prohibited. You further agree not to use the images for sensitive subjects such as sex-related products and services, sexually transmitted diseases, substance abuse, alcohol, tobacco, AIDS, cancer, mental health conditions, alternative lifestyles, or physical or mental abuse, without prior written consent from Raksh.

4. LIMITATION ON WARRANTIES AND LIABILITY

The pictures/videos and information provided on Raksh's sites and servers are offered "as is," with no warranty of any kind, either express or implied. This includes, without limitation, any warranty regarding the information, services, or products offered through or in connection with Raksh, and any implied warranties of merchantability, fitness for a particular purpose, privacy expectations, or non-infringement.
This disclaimer applies to any damages or injuries caused by failures in performance, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, computer viruses, communication line failures, theft, destruction, unauthorized access to records, alterations, or unauthorized use, regardless of whether they arise from breach of contract, tort, negligence, or any other legal cause of action.

5. JURISDICTION

This agreement will be governed exclusively by the laws of New Delhi, India, without regard to its conflict of laws principles. You and your company explicitly consent to the exclusive jurisdiction of the courts in New Delhi and agree to the personal jurisdiction of those courts. If any provision of this agreement is found to be unenforceable, it will be modified only to the extent necessary to make it enforceable.

6. TRADEMARKS

Raksh and picturesbazaar are registered trademarks of Raksh Audio & Visuals Proprietorship Company, registered in India.

7. ASSIGNABILITY

You may not assign or transfer the rights granted to you under this agreement to anyone else without obtaining prior written consent from us.

8. ENTIRE CONTRACT

You acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this agreement. You further agree that this document represents the complete and exclusive agreement between you and Raksh, superseding any previous proposals, agreements (whether written or oral), or other communications relating to this subject. The FAQ explanations and other content provided on Raksh's website are for informational purposes only and are not considered part of this agreement.
